Signpost provides a platform that enables information exchange for the mobile phone and web user communities (referred to hereafter as "the Service") subject to the following Terms of Use. Signpost uses reasonable efforts to ensure that the Service is available on a 24/7 basis. However, there will be occasions when the Service will be interrupted for maintenance, upgrades and emergency repairs or due to failure of equipment that are beyond the control of Signpost and its owners. By using the Service in any way, you are agreeing implicitly or explicitly to comply with the Terms of Use set forth within as they may be updated from time to time.
By using the Service you agree that it shall not be liable to you for any modification, suspension or discontinuance of the Service. Signpost reserves the right, at its sole discretion, to change, modify or otherwise alter these terms and conditions at any time. Such modifications shall become effective immediately upon the posting thereof. Signpost may terminate the Service, for any reason, and without notice, without liability to you, any other user or any third party. You are advised to periodically check this website and review this agreement on a regular basis to keep yourself apprised of any changes. Should you object to any term or condition of the Terms of Use, any guidelines, or any subsequent modifications thereto or become dissatisfied with Signpost in any way, your only recourse is to immediately discontinue use of the Service.
All materials created, contributed, retrieved or published to the Service by any user of the Service shall be referred to herein as "Content." By communicating with, you have provided consent to share information, opinions, advice, tips, warnings, etc. in the form of written posts on Signpost's platform. You may publish posts to the Signpost platform, so long as the content is not - illegal, obscene, defamatory, hateful, invasive of privacy, or features referral codes. Signpost reserves the right to, but has no obligation to, remove Content and block user accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use. You represent and warrant that you own or otherwise control all of the rights to the content that you submit to Signpost; that use of the Content you supply does not violate this policy and will not cause injury to any person or entity. Signpost attempts to maintain a website that is absent of offensive, indecent or objectionable Content. Signpost does not guarantee the accuracy, integrity, or quality of any of the Content, and we make no representations or warranties of any kind about the Content. You understand that by using Signpost, you may be exposed to this Content. Under no circumstances will Signpost be liable in any way for any Content, including, but not limited to, the subject matter of any Content, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content published, emailed, transmitted or otherwise made available via Signpost platform or website. Signpost claims no ownership interest in the user Content. You acknowledge and agree that if you contribute any Content, you grant to Signpost a perpetual, non exclusive worldwide, royalty-free, transferable right and license to use in any way such user Content (including all related intellectual property rights) to provide the Service.
Users of the Services must be at least 13 years of age. Children under the age of 13 are not permitted to use the Service and no information of children under the age of 13 will be knowingly collected by Signpost. Users agree not to attempt to gain unauthorized access to the Service, other accounts, computer systems or networks connected to the Service, through password mining or any other means. Users agrees not to create a false identity or otherwise attempt to mislead others as to the identity of the sender or the origin of Content. User agrees to only enter email addresses that are controlled by or under the common control of that User. If Signpost finds email address information that Signpost suspects to be false, inaccurate, not current or otherwise not under the control of User, Signpost has the right to suspend or terminate the Service and refuse any and all current or future use of the Service, or any portion thereof. Users must not abuse, harass, threaten, impersonate or intimidate other Signpost users. Users may not use the Service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content. Users must not transmit any worms or viruses or any code of a destructive nature. Users understand and agree that by creating fraudulent accounts in order to improve your standing on Signpost is a violation of the Terms of Service. Such violations may subject the user and his or her agents to removal from Signpost.
The Service is provided to you free of charge, however you are solely responsible for any fees, charges and expenses incurred by you in accessing and using the Service.
Your use of the Service or the Signpost website, mobile websites, and mobile applications signifies acknowledgement of and agreement to our Privacy Policy. You further acknowledge and agree that Signpost may, in its sole discretion, preserve or disclose your Content, as well as your information, such as email addresses, IP addresses, timestamps, and other user information, if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: comply with legal process; enforce the Terms of Use; respond to claims that any Content violates the rights of third-parties; respond to claims that contact information of a third-party has been posted or transmitted without their consent or as a form of harassment.
You understand and agree that forwarding unsolicited messages and posts whether in bulk or individual form to Signpost users is expressly prohibited by these Terms of Use. Any unauthorized use of the Signpost computer systems is a violation of the Terms of Use and such violations may subject the sender and his or her agents to civil and criminal penalties.
Your interactions with organizations and/or individuals found on or through the Service, including advice, delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals. You agree to indemnify and hold Signpost, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, of any sort, including financial loss, attorney fees and court costs made by any third party due to or arising out of Content you publish, retrieve or make available through the Service, your use of the Service, your violation of the Terms of Use, your breach of any of the representations and warranties herein, or your violation of any rights of another. If there is a dispute between users of the Service, or between users and any third party, you understand and agree that Signpost is under no obligation to become involved, and shall not be responsible or liable for any loss or damage of any sort. In the event that you have a dispute with one or more other users, you hereby release Signpost, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and / or our service.
If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify Signpost for notice of claims of copyright or other intellectual property infringement at: A good faith statement by you that the disputed use is not authorized by the copyright owner, its agent, or the law; A description of the copyrighted work or other intellectual property that you claim has been infringed; A statement by you declaring under penalty of perjury that (a) the above information in your Notice is accurate, and (b) that you are the owner of the copyright interest involved or that you are authorized to act on behalf of that owner; Your name, address, telephone number, and email address. Upon receiving your complaint, Signpost may, in its sole discretion, remove the Content that you believe infringes your copyright. In addition, Signpost may block the use of the Service to the user who appears to be infringing your intellectual property rights.
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Use or your use of the Service shall be filed only in the federal courts located in the State of Delaware, or state courts located in the county of New Castle and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or these Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.
